Agreement

By using Paw Navigator— including this website, our emergency guides, website, and iOS application — you agree to these Terms of Use ("Terms") with SWIFTOPS INC., doing business as Paw Navigator ("Paw Navigator," "we," "us," or "our"). If you do not agree, do not use our services.

How you accept. For this website and related web services, your use of the service after these Terms are posted constitutes your agreement (browsewrap). For the iOS application, you must affirmatively accept our first-launch disclosure before using the app (clickwrap). In both cases, continued use after we update these Terms constitutes acceptance of the revised Terms, subject to the notice described below.

Eligibility

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction if higher, to use the service. Paw Navigator is not directed at children under thirteen (13) without verifiable parental consent. If you use the service on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.

No veterinarian-client-patient relationship

Use of Paw Navigator does not create a veterinarian-client-patient relationship (VCPR) between you and SWIFTOPS INC., doing business as Paw Navigator, its owners, contributors, or any affiliated veterinarians.

Paw Navigator is an educational information service. Paw Navigatordoes not examine your pet, provide individualized veterinary advice, prescribe treatment, or assume responsibility for your pet's medical care. You should consult your own licensed veterinarian regarding your pet's health. See our Disclaimer for more detail.

Educational use only

Paw Navigatorprovides educational emergency guidance and veterinary care navigation only. It is not a substitute for professional veterinary care, diagnosis, or treatment. Always consult a licensed veterinarian regarding your pet's health. Guidance from structured decision flows and urgency categories is educational decision support based on limited information you provide — not a veterinary assessment of your pet's condition.

What Paw Navigator provides

Paw Navigator includes educational emergency guides on this website, structured decision flows in the app, conservative urgency guidance, optional pet profiles, incident summaries you can share with a veterinarian, and — when available — tools to locate emergency veterinary hospitals. Guidance is based on hand-authored decision flows, not generative AI. Core emergency flows are designed to work offline and without an account.

Acceptable use

You agree to use Paw Navigator only for lawful, personal purposes. You may not misuse the service, attempt to disrupt it, circumvent access controls, or rely on it as your sole basis for medical decisions about your pet. Restrictions on copying, scraping, and commercial use of our content are set out in the Intellectual property rights section below.

Intellectual property rights

Ownership. SWIFTOPS INC., doing business as Paw Navigator and its operators, affiliates, and licensors retain all right, title, and interest in and to the service and all materials made available through it. This includes, without limitation, website pages and design; emergency guides and educational articles; structured decision flows, decision trees, urgency categories, and related logic; text, copy, graphics, icons, photographs, and audiovisual materials; software, source code, object code, and application interfaces; databases, compilations, and arrangements of content; logos, branding, and trade dress; and all updates, enhancements, and derivative works thereof. No ownership interest is transferred to you by your use of the service.

Copyright. All content on Paw Navigator is protected by copyright and other intellectual property laws. Except for the limited license granted below, all rights are reserved. Unauthorized reproduction, distribution, public display, or creation of derivative works from our content may violate copyright and other applicable laws.

Trademarks. "Paw Navigator," the Paw Navigator name, logos, app icons, and related branding are trademarks or trade dress of SWIFTOPS INC., doing business as Paw Navigator and its operators. You may not use our name, logos, or branding in connection with any product, service, website, or material without our prior written consent. Nothing in these Terms grants you any license or right to use our trademarks except as necessary to identify the service when referring to it in a factual, non-misleading manner for personal commentary that does not imply endorsement or affiliation.

Limited license. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the service and its content solely for your personal, non-commercial, educational use — for example, to review emergency guidance for your own pet in a genuine emergency or learning context. This license does not permit any use beyond what is expressly allowed here or required by applicable law.

Prohibited uses. Except as expressly permitted by these Terms or applicable law, you may not, and may not permit any third party to:

  • scrape, crawl, harvest, spider, or systematically download content from the service, including the emergency guide library, decision flows, or related databases;
  • bulk download, mirror, frame, or republish any portion of the service or its content;
  • copy, reproduce, redistribute, transmit, display, perform, publish, or otherwise make available our content or software;
  • create derivative works, adaptations, translations, or compilations based on our content, guides, flows, or software;
  • use our content or service for any commercial purpose, including resale, licensing, training data for automated systems, or inclusion in another product or service, without our prior written consent;
  • access the service through automated means (including bots, scripts, scrapers, or similar tools) except through interfaces we expressly authorize;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, underlying logic, or non-public APIs from the app or service, except to the extent such restriction is prohibited by applicable law;
  • remove, alter, or obscure copyright, trademark, or other proprietary notices.

Enforcement and remedies. We may investigate suspected violations and suspend or terminate access without notice. We reserve all rights and remedies available at law and in equity, including seeking injunctive or other equitable relief to prevent or stop unauthorized use, copying, scraping, or infringement of our intellectual property, without the requirement of posting a bond where permitted by law. Violations may also result in civil or criminal liability under applicable intellectual property and computer-fraud laws.

Third-party information

Emergency veterinary hospital listings, maps, and external links are provided for convenience. We do not control third-party websites or clinics and are not responsible for their services, availability, or accuracy. Poison control and veterinary helpline numbers may change; confirm current numbers before use.

No warranty

The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that information is accurate, complete, current, or suitable for your specific situation, or that the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, SWIFTOPS INC., doing business as Paw Navigator and its operators, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from your use of or reliance on the service — including delays in seeking veterinary care or decisions made based on educational guidance.

To the fullest extent permitted by law, our total liability to you for all claims arising from or relating to the service shall not exceed the greater of (a) the amount you paid us for the service in the twelve (12) months before the claim arose, or (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless SWIFTOPS INC., doing business as Paw Navigatorand its operators, affiliates, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the service, your violation of these Terms, or your violation of any rights of another person or entity.

Dispute resolution and mandatory arbitration

Please read this section carefully. It affects your legal rights, including your right to bring claims in court, to have a jury decide your claims, and to participate in a class action.

Informal resolution first. Before initiating arbitration or filing a claim in court, you agree to contact us at info@pawnavigator.com with a brief written description of the dispute and the relief you seek. You and Paw Navigator will attempt in good faith to resolve the dispute informally for at least thirty (30) days from the date we receive your notice. The informal-resolution period is a condition precedent to arbitration or court action, except for requests for temporary or preliminary injunctive relief.

Agreement to arbitrate. Except as set forth below, you and Paw Navigator agree that any dispute, claim, or controversy arising out of or relating to these Terms, the service, your use of the service, or the relationship between you and Paw Navigator(each, a "Dispute") will be resolved exclusively through final and binding individual arbitration, not in court. This agreement to arbitrate is intended to be broadly interpreted and applies to all Disputes, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether arising before or after you accept these Terms.

Exceptions. Either party may bring an individual action in small claims court if the claim qualifies and remains in that court. Either party may also seek temporary or preliminary injunctive relief in a court of competent jurisdiction to prevent unauthorized use of the service, misuse of intellectual property, or other harm pending arbitration, without waiving the obligation to arbitrate the underlying Dispute on an individual basis.

Arbitration rules and administrator. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules ("AAA Rules") in effect when the Dispute is filed, as modified by this section. The AAA Rules are available at www.adr.org. If the AAA is unavailable or unwilling to administer the arbitration, the parties will select an alternative administrator that provides substantially equivalent consumer arbitration procedures, or a court of competent jurisdiction will appoint one.

Arbitration venue and hearing location. The seat and legal place of arbitration is Clark County, Nevada, United States. Unless you and Paw Navigator agree otherwise, any in-person arbitration hearing will take place in Clark County, Nevada, or — if permitted by the AAA Rules and agreed by the parties — by telephone, videoconference, or based on written submissions. The arbitrator may hold hearings and conferences remotely where the AAA Rules allow.

Arbitrator and process. The arbitration will be conducted by a single neutral arbitrator selected under the AAA Rules. The arbitrator will have exclusive authority to resolve all Disputes, including whether a Dispute is arbitrable and whether any part of these Terms is void or unenforceable, except that a court — not the arbitrator — decides class-action waiver enforceability as described below. The arbitrator may award any relief available in court on an individual basis, subject to these Terms. The arbitrator's award will include a written statement of decision and will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Waiver of jury trial. You and Paw Navigator each knowingly and voluntarily waive any right to a trial by jury for any Dispute resolved in court or in arbitration. If for any reason a Dispute proceeds in court rather than in arbitration, you and Paw Navigator waive any right to a jury trial to the fullest extent permitted by law.

Class action waiver. You and Paw Navigatoragree that each may bring claims against the other only in an individual capacity, and not as a plaintiff, class member, or participant in any purported class, collective, consolidated, private attorney general, or other representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class, collective, consolidated, or representative proceeding. If a court determines that the limitations in this paragraph are unenforceable as to a particular claim or request for relief, and all appeals from that determination have been exhausted or the time to appeal has expired, that claim or request for relief may be severed and litigated in court, but this arbitration agreement will continue to apply to all remaining Disputes and parties.

Arbitration fees and costs. Payment of filing, administration, and arbitrator fees will be governed by the AAA Rules. If the arbitrator finds that either the substance of your claim or the relief sought is frivolous or brought for an improper purpose (as measured by the standards in Federal Rule of Civil Procedure 11(b)), Paw Navigatormay seek recovery of its attorneys' fees and costs to the extent permitted by applicable law and the AAA Rules.

Federal Arbitration Act. This arbitration agreement is made pursuant to a transaction involving interstate commerce and is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.), which applies to the interpretation and enforcement of this section notwithstanding any choice-of-law provision elsewhere in these Terms.

Thirty-day opt-out. You may opt out of this arbitration agreement and the class action waiver by sending written notice to info@pawnavigator.com within thirty (30) days of the date you first accept these Terms (including by using the website or affirmatively accepting the first-launch disclosure in the iOS app). Your notice must include the subject line "Arbitration Opt-Out," your full name, the date you first accepted these Terms, and the email address or device identifier associated with your use of the service. Opting out will not affect any other provision of these Terms. If you opt out, you and Paw Navigator agree that Disputes will be resolved in court as described in Governing Law and Venue, and the class action waiver will not apply to you.

Severability of arbitration provisions. If any portion of this Dispute Resolution section is found to be invalid or unenforceable, that portion will be severed and the remainder will remain in full force and effect, except that if the Class Action Waiver above is found to be invalid or unenforceable in its entirety with respect to a Dispute, then — as to that Dispute only — the entirety of this Dispute Resolution section will be null and void and the Dispute will be resolved in court as set forth in Governing Law and Venue.

Governing law and venue

These Terms and any Dispute not subject to mandatory arbitration (or for which arbitration has been validly opted out) are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration agreement as stated above.

Subject to the Dispute Resolution section, you and Paw Navigator agree that any judicial proceeding (including any permitted small claims action or post-arbitration enforcement) will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to personal jurisdiction and venue in those courts. You waive any objection to venue in Clark County, Nevada, including any claim that such forum is inconvenient.

Termination

We may suspend or terminate your access to the service, in whole or in part, at any time, with or without notice, if we reasonably believe you have violated these Terms, pose a risk to the service or other users, or if we discontinue or materially modify the service. You may stop using the service at any time by uninstalling the app or ceasing use of the website. Upon termination, your right to use the service ends immediately. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, and venue — will survive.

Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of substantially all of our assets, or to an affiliate, without your consent. Any attempted assignment in violation of this section is void.

Severability

If any provision of these Terms other than the Dispute Resolution section is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Severability of the arbitration and class action provisions is governed exclusively by the Severability of arbitration provisions paragraph in Dispute Resolution and Mandatory Arbitration above.

Entire agreement

These Terms, together with our Disclaimer and any other policies referenced herein, constitute the entire agreement between you and SWIFTOPS INC., doing business as Paw Navigator regarding the service and supersede all prior or contemporaneous understandings regarding the service. If there is a conflict between these Terms and a platform-specific policy required by an app store, the platform policy controls only to the extent required by that platform.

Changes to terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms. Material changes may be noted on this page with an updated date. For the iOS application, material changes may require renewed acceptance where required by applicable law or app store policies.
